U.S. citizens can petition for parents, spouses, siblings, and children. Permanent residents can petition for spouses and children only. There is no quota or limit and, therefore, no waiting time for “immediate relatives” of U.S. citizens – unmarried children under 21, spouses, parents, widows / widowers (under certain circumstances). Relatives in the following preference categories are subject to limits on the number of visas that can be issued each year.
First Preference –unmarried sons or daughters (over age 21) of U.S. citizens
Second Preference (2A) –spouses and unmarried children (under age 21) of LPRs; and (2B) unmarried sons and daughters (over age 21) of LPRs
Third Preference – married sons and daughters of U.S. citizens
Fourth Preference – brothers and sisters of U.S. citizens
Diversity Visa (DV1 / “Green Card Lottery”)

If you’re found to be “inadmissible” to the United States, you are prevented from obtaining lawful permanent residence and from obtaining non-immigrant visas. However, you may qualify for an immigration waiver. Examples of waivers of inadmissibility include I-601 Hardship Waiver, I-601A Provisional Waiver, Criminal Conviction Waiver, Misrepresentation or Fraud Waiver and Unlawful Presence Waiver.

There are two primary ways in which a person may apply for asylum in the United States: the affirmative process and the defensive process. Asylum seekers who arrive at a U.S. port of entry or enter the United States without inspection generally must apply through the defensive asylum process. Both processes require the asylum seeker to be physically present in the United States.
Affirmative Asylum – A person who is not in removal proceedings may affirmatively apply for asylum through U.S. Citizenship and Immigration Services (USCIS), a division of the Department of Homeland Security (DHS). If the USCIS asylum officer does not grant the asylum application and the applicant does not have a lawful immigration status, he or she is referred to the immigration court for removal proceedings, where he or she may renew the request for asylum through the defensive process and appear before an immigration judge.
Defensive Asylum –A person who is in removal proceedings may apply for asylum defensively by filing the application with an immigration judge at the Executive Office for Immigration Review (EOIR) in the Department of Justice.

Defective Product

Wrongful Death
